The dead body was exhumed from the grave after 2 months and 27 days in Hossainpur of Kishoreganj.

On Tuesday, April 30, 2024, Siraj Uddin’s body was exhumed from the grave of Madkhla village in Hossainpur upazila of Kishoreganj district.  It is known from local residents and relatives and plaintiff Nachima Khatun and from the information of Court CR Case No. 461/2023 that accused Golap Gangra is an extortionist, land robber.  Nachima Khatun, the only daughter of late Siraj Uddin is helpless and poor woman and deceased Siraj Uddin is also a poor man.  Parents lead their lives with the help of humans.  Nachima said my father wrote 06.66/100 percent of land in my name on deed No. 3768/22 on last 14/11/2022.  I have taken possession of the said land and have been cultivating various plants and vegetables along with filling the soil.  The accused has been pressurizing me in various ways to sell the said land to Golap Gongra.  When I expressed my reluctance to sell, the defendants threatened me that they would seize my land by force at any time if I did not sell.

Past 27/10/2023 A.D.: I went to the land given by my father and found that the defendants were uprooting my planted vegetables and fencing them with nets.  As soon as I objected, accused No. 1 gave the order and said, “Put the Shalids to death today”.  As soon as he said this, the accused No. 2 hit me with a stick in their hand and injured my uncle in a way that caused a bruise.

When my mother came forward to rescue me, accused No. 1 tried to kill me with a stick. Witness No. 1 hit my mother with a bar on her head. When my mother fell down, the bar hit my mother’s face, causing severe bleeding injuries on her lips and mouth, and one of her lower teeth was broken and her upper teeth fell out.  Rows of teeth fight.  Accused No. 1 Golap Mia injured my old father with a bamboo stick in his hand.  Accused No. 2 gave my father a few punches on his chest and when he fell on the ground, he tried to kill him by pressing his throat with both hands and choking him.  Then the people around the village came forward and rescued them from their grip and when the accused were leaving, they raised their native weapons and threatened saying that today the people have survived, if I get a chance I will kill them and kill them.  My husband Farooq Mia came to the spot and saw the incident and rushed us to Syed Nazrul Islam Medical College Hospital for treatment in an autorickshaw.  Currently, my parents are under treatment in the hospital.  When I recovered a bit and went to the police station to file a case, the police station authorities suggested filing a case in the learned court, so there was some delay in filing the case in the learned court and the photograph of accused No. 1 was submitted along with the medical documents.

Plaintiff Nachima Khatun, Daughter of Victim Siraj Uddin Death of Victim Siraj Uddin It is the strong belief of the plaintiff that the death of victim Siraj Uddin was caused by the injuries sustained by the accused Golap Gong.  The learned court said that the incident on 27/10/2023, the injured Md. Siraj Uddin (70) was injured by the accused Golap Mia and Halima Khatun and died on 03/02/2024 due to the said injury.  Therefore, he prayed for addition of Section 302 of the Penal Code against the accused.

In the overall review of the court, in the interest of justice, it appears to the court that there is a need to investigate the matter, therefore, the death of the injured Md. Siraj Uddin is due to the injury of the incident dated 27/10/2023. Special Superintendent of Police PBI Kishoreganj-  Who was instructed?  For the purpose of investigation, post mortem report was prepared by exhuming the dead body from the grave in the presence of an Executive Magistrate: The investigating officer was instructed to submit the investigation report.  For this purpose Special Superintendent of Police PBI Kishoreganj has been instructed to take all necessary measures.  Further for this purpose the learned District Magistrate, Kishoreganj was directed to appoint an Executive Magistrate and the Civil Surgeon, Kishoreganj to render necessary assistance.  Next date 25/06/2024 is fixed for receipt of inquiry report.

According to the order of the court, the body of the victim Siraj Uddin has been exhumed from the grave and sent for autopsy.

When the Executive Magistrate in charge was questioned about this, he said, as per the order of the court, we have exhumed the body from the grave, after the autopsy, the cause of death of the victim Siraj Uddin will be known.
